OLD/CURRENT BUSINESS:

I. President’s Report

  • President Frankenfeld informed the Board that he and Lynne attended the memorial service for Mary Ellen Tanner. Even though she was not a member of the Local she was a large part of the local music scene.
  • The bank is trying to assist Rhonda to be able to do banking online.
  • A film focusing on jazz musician Miles Davis will be shot in Cincinnati. The filming will be in need of extras and jazz musicians. Paul has written a letter suggesting that the Local be of assistance in hiring and locating musicians.

II. Electronic Media Agreement

  • Discussion around the EMG is at an impasse. The next meeting that President Frankenfeld will be attending is June 15-17th. The Board granted permission for him to attend.

III. Musicians Performance Trust Fund

  • While in New York with the CSO and May Festival Chorus, Paul met with Samantha Ramos. The State of Ohio received $23,000 for MPTF concerts. He wanted to check on the possibility of using some of those funds for a potential gala concert. Since that type of performance would not be technically “free” and open to the public funding would not be possible.
  • Musica Sacra has been primarily funded through the MPTF and is now going to apply for funding through the Louise Dieterle Nippert Fund.

IV. Cincinnati AFL-CIO Labor Council

  • Doug Sizemore will be stepping down as Executive Secretary due to health problems.
  • There is a move to draft someone that members can rally around in order to avoid a potentially contentious election.
  • The Council is trying to increase younger members.

V. CSO

  • Trey Devey has indicated a willingness to begin early negotiations.
  • Ted Nelson, Drake Ash, and Dan Culnan will be musicians on the negotiating committee.
  • The performance in NY was successful. The soloists were superb and the John Adams piece did have a good performance.

VI. CCO

  • Paul has recently received a response from CCO Board Chairperson Jennifer Funk. There is no need to halt negotiations on a CBA and they will continue in good faith.
  • The final 2013-2014 concert will be June 1. There is expected to be an announcement at the concert regarding next season.

Miscellaneous Announcements:

  • The Musicians Ball will be scheduled for April 24, 2015. Turn out must be improved.
  • Vice President Barb Lambert reminded Board members to get their bios to her for the website.

Next three meetings are tentatively scheduled for June 2nd at noon, June 16 for the Board meeting and the Quarterly General Membership meeting, and a Board meeting on June 30, 2014.

Meeting adjourned at 2:03PM.

The quarterly general membership business meeting of the Cincinnati Musicians’ Association was called to order on March 31, 2014 at 7:19 PM.

15 members were present.

Minutes from the December 9, 2013 quarterly meeting were read and approved.

OLD/CURRENT BUSINESS:

I. Welcome

  • President Frankenfeld welcomed members and apologized for any difficulty getting into the building. Tenants have to sign in after 6PM and there is a new security guard at the desk this evening.

II. FIFTY-YEAR HONOREES

  • President Paul Frankenfeld presented Richard Porotsky his 50-year membership pin and card. Paul shared with the members present memories of Richard’s tenure with the Local. Richard is from Pennsylvania and attended the Curtis Institute of Music. He joined the CSO in the 1963-64 season. He is married to Betty Jean (flute).
  • President Frankenfeld also recognized Marc Cleghorn, in absentia, for 50 years of membership. Mark is currently living in Wisconsin.

III. Focus on Freelancing

  • President Frankenfeld began by recognizing several performance groups and concert series in the area that use freelance musicians. These groups perform regularly but do not necessarily have a CBA with the Local. Many have a Memorandum of Agreement (MOA)clearly stating a scale that is equal to or above current scale listed. The Board is due to discuss the price list, which will be expiring soon, and it will be in keeping with neighboring locals. As President, he wants to hear from members as the discussion begins.
  • It is not the duty of the Local to get jobs for members. If work is available the Local can push to create opportunities if possible. The new casino is an example of potential opportunity. Booking agencies are almost a thing of the past since musicians can promote their own music through their own websites. Work dues and pension contributions are not paid if people contract themselves. Look at CityBeat and you can find tons of free music available any night.
  • The Local doesn’t want to deprive any musician from getting work but there is concern about any non-union group paying under scale. An example is the Kentucky Symphony Orchestra. The Kentucky Symphony Orchestra hits 6 markers that indicate its players are employees and not independent contractors. A ‘Fence Agreement’ could provide a solution. This would provide an agreement where members of the Local would receive a negotiated scale.
  • Q: Since the MOAs with other groups have been drawn up, does the KSO jeopardize other area orchestras?
  • A: Case in point. The Carnegie Center for Visual and Performing Arts (The Carnegie)    has used the CCO in the past for their performances. Space only allows for a total of 17 players. Management of the KSO presented a much lower budget than the CCO but used members of the Local. Apparently something occurred because the Carnegie is reaching back out to the CCO and BAMSO. The Local is trying to preserve work at reasonable scale for members. The Local is willing to sit down with the Carnegie and look at their budget for the productions. The scale could be adjusted with an MOA and could provide about 13 services for area musicians.
  • Q: What is the Kentucky Symphony Orchestra’s reasoning for not being a union organization?
  • A: Unknown.

OPEN DISCUSSION/COMMENTS:

  • Elizabeth Motter (harp) pointed out that freelancers rely on many things to make a living. She has noticed big changes in just the last 5-7 years. There is much less opportunity. A younger generation is doing the hiring and they seem to prefer recorded music.
  • José Mangual(trombone) pointed out that a big problem is the budget cuts in schools. Arts are often the first thing to go. As an educator he knows first hand that his students are not being exposed to live music. José asked if the Local be doing anything to show freelancers the benefits of being a member. The benefits are on the website so it is just a matter of getting freelancers to look at what the Local offers.
  • President Frankenfeld closed the discussion with the following comments. He asks that all freelancers let the Board know what your needs are. How can we help you? If you are a member of a performing group, please leave materials in case an opportunity arises. The big question is how do we change the minds of the larger community population? How do we show the importance of having live music?

  • Paul has been able to rent storage space in the building for the chairs and stands. Getting these items into storage will help open up the office space. Rent will be $43 a month. There is a larger space that is available if we need it in the future.
  • Karen Frye has been in contact with Paul regarding the internment ceremony in Oregon for her father, Gene Frye. The Board expressed a desire to see a memorial service held locally sometime around the one-year anniversary of Gene’s passing. Paul will look into the possibility of having one in the foyer of Music Hall.

II. CCO

  • There is a need for a memorandum of agreement with the CCO so that pension payments can be taken care of for the players.
  • There is considerable interest from conductors for the CCO position. The Board needs to determine the vision for the organization before the position is filled.

III. CSO

  • An issue surrounding the double rehearsal scheduled for Monday, April 14, 2014 has arisen which is causing major discussion between players and management. A similar situation has been discovered during next season and steps are being taken to resolve the situation as quickly as possible.

IV. Musicians Ball

  • Ticket sales are down. This is not unexpected due to the late start in organization and the date coinciding with Good Friday. Lynne and Carol will begin planning for the 50th Annual Ball beginning on Monday, April 21.

  • The clarinet auditions were held this past Tuesday. There were six finalists but no one was selected. The next audition for this position will be bumped back to next season.  Matthew Ernst will be hired for the principal trumpet position.

II. CCO

  •  The organization continues to be in a state of flux. President Paul Frankenfeld submitted a letter calling for increased player involvement. Paul has requested a copy of their financials but to date that request has not been fulfilled. He would like to see how the financial deficits occurred.
  • CCO Board Members have been discussing a wide array of topics ranging from changing the name of the organization to going to a festival concept that could be held at the end of August and beginning of September beginning in 2015.

NEW BUSINESS:

I. Social Media/Professionalism

  • It was brought to the attention of the Board that there have been a couple of situations where members of the Local have been disseminating false information (rumors) and/or disparaging remarks about other members or even musical organizations. If any member has any question or concern about the Local they can always attend a meeting or come to the office for information. Social media etiquette should be discussed. President Frankenfeld will be including an article in the next issue of ‘Overtones”, reminding members to use discretion with social networking.

I. President’s Report

  • President Frankenfeld reported that his trip to Chicago for IMA negotiations were not very productive. Tuesday included breakout sessions which seemed to produce some discussion that might result with some agreement. There was common ground when it came to patch sessions. The next set of negotiations will be held the first weekend in May. Paul will be unable to attend.
  • Vice President Barb Lambert attended the CSO trumpet auditions in Paul’s absence. Matthew Ernst was selected. There was no alternate. Matthew is now subject to a week of playing with the orchestra. He will be performing with the concerts in conjunction with MusicNow. Barb was present for a total of 6.5 hours. Don Hurd presented a motion to reimburse Barb Lambert for the cost of one Board meeting, plus mileage, for time spent at the audition. Lou Lausche provided the second. The motion was approved.
  • The CSO will be going ahead and holding auditions for 1-year appointments and will reprioritize the needed auditions. Three auditions for next year will be a) Associate principal percussion, b) 2nd trombone, c) 2nd Violin – one section and one to fill Cathy Jensen’s chair.
  • The General Membership Meeting scheduled for March 31, 2014 at 7PM will focus on freelance musicians and we will recognize Richard Porotsky and Mark Cleghorn for 50 year memberships.

II. CCO

  • Jennifer Funk addressed the CCO prior to its gala. She was very honest with the orchestra. However, she did not announce the Board plans to discuss restructuring to organization. There had been some discussion with Trey Devey that would allow the CSO to manage the CCO but the Board voted to remain autonomous and have made a commitment for the next 3-4 years.
  • The organization is running a deficit but Paul is reminding them of the verbal agreement of a 5% increase on all services this year. He is also encouraging them to add a communication and planning committee that would include three musicians.
  • No one wants to see the organization evolve into a pick-up group.

III. Musicians Ball

  • Flyers and tickets are in the office. Lynne is beginning to sell tickets.

I.  President’s Report

  • Paul has discussed storage space with Laurie Miller. For $500 a year we could store stands and chairs in the building. It would only require an addendum to the current lease. We would have to provide pallets, as there could be water seepage into the basement with melting snow or heavy rains. The actual cost is $6 per square foot. Paul will get the exact amount of space needed before the Board commits to the expenditure.
  • Paul will be meeting with Laura Sabo regarding the Classical Revolution group located here in Cincinnati.

II. CCO

  • Rebecca Andres, Nat Chaiken and President Paul Frankenfeld met with Mike Cioffi and Jennifer Funk of the CCO Board. Subsequently, Wes Woolard and Nat Chaiken were to make a presentation to the Board. However, Nat received a phone call saying that the presentation would not appear on the agenda and he and Wes would not be expected to appear at the meeting since they were non-voting members of the Board. Paul offered a compromise that the presentation could be given prior to the voting portion of the meeting.
  • March 14, 2014 there will be a negotiation meeting. It will be proposed that the Board should include three (3) musician members that hold voting privileges.

  • The Constitution revisions were approved by a majority of the membership who voted.
  • The current price list will expire in September of 2014. Paul Pillar will speak to the Board at a future meeting to discuss the price list.
  • The Local will be absorbing $5 of the $10 dues increase.
  • The Minnesota Orchestra will have their first concert this weekend. The Minnesota Local is still in need of financial support to assist them during the recovery. The musicians ended up with a 15% wage cut. Don Hurd motioned to donate $500 to the Minnesota Local. Joe Gaudio provided the second. The motion passed.

II. CCO

  • President Paul Frankenfeld and Rebecca Andres met with CCO Board Chair Jennifer Funk and Michael Cioffi. The talks were productive. The next meeting has been scheduled for February 19, 2014.
  • The pension issue has been straightened out and payments can be posted.

III. Ballet Recording

  • Director Carmen DeLeone had requested a special demo price from the Local regarding the recording of the new ballet, King Arthur. Since it would need to be done under full SRLA all musicians would need to be paid whether or not they play the recording. The expense would be prohibitive.
  • The CSO could not even provide a 3 minutes excerpt from an archival recording because the CSO is not signed onto the current IMA.

IV. CSO

  • There is a discussion beginning about the performance of Varese’s Amerique (1926). It requires an additional 43 players. It has been proposed to make this an educational project and include students from CCM. Baltimore did Rite of Spring in a similar fashion. Baltimore does not encourage the CSO to follow suit. It appears to be an end-run to avoid hiring extra players. The performance would be a part of the subscription season. That indicates that the performance really wouldn’t be ‘educational’. There may be a way to involve an educational component so discussion will continue.
  • IMA negotiations were held in NY on Monday, January 27. The meeting began with a caucus. No real movement happened once all parties met. The next three meetings will be held in March, May, and June.
  • The estate of Charles Yeiser left monies to CSO players that are still with the orchestra after the previous contract negotiations. The provision should include librarians but there has been some pushback. More information will be forthcoming.
  • Due to the Polar Vortex the organization is trying to make arrangements for the Lollipop Concerts that were postponed.

I. President’s Report

  • President Paul Frankenfeld read a letter from Richard Porotsky certifying the results that members of the Board had been reelected by acclamation.
  • Ballots have been returned for the constitution revisions.  Richard Porotsky will be handling the ballot tabulation on Thursday, January 16, 2014.
  • The AFM has a new Public Radio rate but it needs to have an addendum stating that the agreement is “as of” a certain date and not retroactive.
  • President Frankenfeld reported that there was a low turnout at the Taft Chamber Concert due to the sever weather forecast. He may reschedule the group for a fall date.
  • Players for the ‘Book of Mormon’ will be paid through direct deposit.  Since there is a fee associated with this it will be billed back to the touring company.

II. CCO

  • President Paul Frankenfeld will be meeting with Jennifer Funk and Mike Cioffi on January 16 at 2pm in Mike Cioffi’s office.
  • Paul would like to ask either Rebecca Andres or Nat Chaiken to also attend the meeting.

III.  Ballet

  • The Ballet would like to record a new ballet, King Arthur.  This will be a world premiere. Robert McGrath will inform the ballet that it can be done at the full SRLA rate.  For 60 musicians that would be about $75-80,000.
  • The Ballet was reminded that they could do a fixed camera archive recording.
  • The performance will be the second week in February.
  • There is some discussion regarding the Ballet not paying for doubling. They prefer an additional player be hired in lieu of doubling.

IV. CSO

  • Since there was no winner of the trombone audition the orchestra will have a player begin on a weekly service contract.
  • Management would like a fundraising event during the Pops tour to Florida.  A day off in Sarasota is the desired day.  Discussion is in process.
  • To date 37 players have participated in 430 educational services that give a “service credit” in return.
  • President Frankenfeld will be speaking with the Personnel Manager and the Assistant Personnel Manager.  It has reached Paul that substitute players are being asked their opinion about other substitute players.  This is not acceptable and needs to be dealt with quickly.

NEW BUSINESS:

I. New Year’s Eve Ball

  • There have been some complaints about the band that was used at the Ball.  It was a non-union group.  Communicating with the committee that plans the event is difficult.  The age range of the audience basically dictates the style of music and the Local does not currently have any bands playing the genre that was desired for the last couple of years.

II. Musicians Ball

The Managers presented an offer regarding the IMA which was set up in 2009. Their proposal would have amounted to players not being compensated as established in the current agreement.
  • The next meeting is scheduled for late January 2014.

II. KSO

  • President Paul Frankenfeld has been working on a letter to members that perform regularly with the Kentucky Symphony Orchestra.  The KSO provides important work opportunities for our members but there needs to be a conversation between the Local and the players.

III. CCO

  • President Frankenfeld is working to schedule a meeting with Jennifer Funk and anyone else she feels should meet together regarding the CBA.  President Frankenfeld would like to see the agreement extended for another year and seek retroactive pay for the players.
  • The organization is facing several challenges.  They must search for a new Music Director, they do not have a permanent home, and it may be time to develop a new long-range plan.

IV.Office Equipment Update

  • Carol Dunevant presented a motion to purchase 2 external hard drives, a scanner, copier/printer, and a flash drive to be used in the office. Joe Gaudio provided the second.  The motion was passed unanimously.  One hard drive will be dedicated to archive material and the other will be used for backing up Rhonda’s computers.  The flash drive will be for daily backups and the scanner will be used to begin digitizing archive material for preservation.
